Terms of service

FARMISON & CO

TERMS AND CONDITIONS OF SALE

New Farmison Limited  |   31 October 2026

These terms have been adapted from the published Parson’s Nose terms. They do not automatically adopt that business’s London shop services, delivery tariffs or cut-off times. Items requiring confirmation are identified in the publication checklist at the end.

1. Who we are and these terms

The website www.farmison.com and the Farmison & Co online store are operated by New Farmison Limited (referred to as “Farmison”, “we”, “us” or “our”). Our business contact address is 5 Heathman’s Road, London SW6 4TJ, United Kingdom. Email: enquiries@farmison.com. Our registered company number, registered office (if different) and VAT registration number should be displayed where applicable once verified.

These terms apply to consumer orders placed through our online store. By placing an order, you agree to these terms. Nothing in these terms affects your statutory consumer rights. Where a mandatory legal provision conflicts with these terms, that legal provision prevails.

2. Ordering and formation of the contract

Product descriptions, availability and prices appear on our website. After checkout we may send an acknowledgement of your order; this does not necessarily constitute acceptance. A contract is formed when we confirm acceptance, such as when we send a dispatch or express order-acceptance confirmation. We may decline an order where an item is unavailable, a pricing error is apparent or we are unable to fulfil it lawfully; any payment taken for an unaccepted order will be refunded.

You must provide accurate delivery and contact information and ensure somebody can receive or safely manage the delivery of perishable goods. Any special requests are subject to our written acceptance.

3. Prices and payment

Prices and applicable delivery charges will be shown before you confirm and pay for an order. VAT, where applicable, is included or displayed in accordance with applicable law. Payment must be authorised using a method offered at checkout. Promotional offers, vouchers and credits may carry separate conditions clearly disclosed when issued; none will override statutory rights.

4. Availability and substitutions

We specialise in quality produce, including items in limited supply. Availability can vary. If an ordered product is unavailable, we will contact you to offer a suitable alternative where possible or a refund for that item. We will not make material or lower-quality substitutions without your agreement. If we cannot fulfil the whole order, you may be entitled to cancel it and receive an appropriate refund.

5. Approximate weights

Fresh meat is prepared individually and product weights may vary from the indicative weights shown online. Where a product is sold by a specified weight or minimum-weight band, we will use reasonable care to meet that description. Any stated tolerance, such as the 10% variation used in Parson’s Nose’s published terms, must be clearly disclosed on the relevant product page and must not result in goods being materially different from their description or limit statutory remedies. Where an item is materially underweight, incorrectly described or otherwise non-conforming, we will provide the remedy required by law.

6. Delivery areas, charges and dates

Eligible delivery postcodes, shipping charges, minimum order values, order cut-off times and available dates will be displayed on our website or at checkout. Do not rely on Parson’s Nose delivery prices or London services; they do not apply unless separately advertised by Farmison. Delivery dates or windows are estimates unless we expressly agree that a particular date is essential or otherwise guaranteed.

We will use reasonable care in preparing and dispatching your order and will keep you informed of material delays. We remain responsible for delivering goods in conformity with the contract, including when we use a third-party courier, subject to applicable legal exceptions. A courier notification or leaving instructions does not by itself remove statutory rights.

7. Receiving perishable goods and failed deliveries

Please ensure that delivery instructions and the address are accurate and that someone can receive your delivery, or that a safe delivery arrangement is expressly agreed where suitable. Refrigerate or freeze products promptly as indicated by their packaging. Where delivery cannot be completed due to incorrect information, refusal or lack of access, reasonable additional delivery or handling costs may apply if these were disclosed and the law permits. We will assess responsibility for any failure fairly, taking account of the circumstances and your statutory rights.

8. Packaging, freshness and storage

We use packaging appropriate to the products and anticipated transit conditions. Items may be supplied fresh, chilled or frozen as stated in their product descriptions and labels. Please follow all use-by dates and storage instructions. If a package arrives damaged, warm, leaking, spoiled or otherwise unsafe, do not consume affected products; contact us promptly with the order number and supporting photographs if available.

We cannot guarantee a universal shelf life for all products. The label and specific product information take precedence over general guidance.

9. Allergens and product information

Products may contain allergens or be handled in environments where allergens are present. Please read the ingredients, allergen declarations and packaging information relevant to each product before use. Contact us before ordering if you need clarification; we will provide the information available to us. We do not seek to exclude liability where inaccurate allergen or food safety information breaches applicable legal duties.

10. Cancelling or amending an order

For standard orders outside the Christmas period, customers may voluntarily cancel an order up to four full calendar days before the selected delivery date, subject to any product-specific restrictions clearly disclosed before purchase. To request cancellation or amendment, email enquiries@farmison.com with your order number. Many fresh and perishable food products are exempt from the ordinary 14-day online change-of-mind cancellation right; non-perishable items may retain that statutory right where applicable.

For orders due for delivery within the next three calendar days, we may already have purchased, prepared or dispatched the produce. We do not ordinarily accept voluntary cancellations or changes at this stage. Any goodwill refund or credit is at our discretion, without affecting statutory rights where goods are faulty, misdescribed, not supplied or otherwise fail to conform to the contract.

11. Christmas orders — no change-of-mind cancellations or refunds

Christmas orders are planned and produce may be reserved or purchased specifically from our farmers and suppliers. For fresh or otherwise rapidly perishable Christmas products, including Christmas turkeys, there is no voluntary right to cancel, return or receive a refund merely because a customer changes their mind once the order is placed. Christmas turkeys are non-cancellable from the point we accept the order. For other Christmas orders scheduled for delivery or collection after 10 December, no voluntary cancellations, refunds, gift cards or store credits will be offered for cancellation requests made after 10 December. Any earlier cancellation request is subject to our ordinary cancellation rule unless product-specific restrictions were clearly disclosed at checkout. We may, entirely at our discretion, offer a goodwill credit on an eligible cancellation request made more than one month before delivery, but this is not guaranteed. These restrictions apply only where legally permitted, notably to qualifying perishable or genuinely bespoke goods; they do not override any statutory cancellation right that applies to a non-perishable product or statutory remedies for faulty, unsafe, misdescribed, missing or undelivered goods, or where we cancel or fail to fulfil an order. Customers should read the Christmas cancellation notice before paying.

12. Quality concerns, complaints and remedies

We take product quality and food safety seriously. If you have a concern, contact enquiries@farmison.com as soon as reasonably possible, ideally within 24 hours for perishable items, stating your order number, description of the issue and photographs where practical. The 24-hour period is a request to help us investigate promptly, not a deadline that removes statutory rights.

Depending on the problem and applicable law, remedies may include replacement, price reduction, refund or other appropriate redress. Do not send perishable items back without contacting us first; we may instead request photos or arrange appropriate collection. We will not automatically require you to pay return postage for faulty or misdescribed goods.

13. Refunds

Where a refund is legally due, including for faulty, misdescribed, missing or undelivered items, we will issue it in accordance with applicable law, normally to the original payment method. We will not substitute store credit where the customer has a legal right to a monetary refund. Outside the Christmas policy in section 11, voluntary cancellations follow the standard terms in section 10. For qualifying Christmas perishable orders, no change-of-mind refund or cancellation is available as described in section 11; statutory rights remain unaffected.

14. Gift cards, subscriptions and other services

If Farmison offers gift cards, subscriptions, memberships or services, additional specific terms may apply and will be shown before purchase. They must explain renewal, pricing, cancellation, expiry and any other material restrictions as appropriate. A subscription will not be created or renewed on terms that were not properly disclosed and agreed. Parson’s Nose cooking-class or retail-shop collection terms have not been imported into these Farmison terms.

15. Website content and intellectual property

Website text, graphics, photographs, logos and other materials are owned by us or licensed to us and are protected by applicable intellectual property law. You may use the site for personal shopping; you may not reproduce content for commercial purposes without permission. Product images may show serving suggestions or cooked presentation, so please rely on the written product description for the precise goods supplied.

16. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded, or your statutory rights under consumer legislation. We do not exclude liability for failures of the courier as a blanket rule. We are not responsible for losses that are not foreseeable or not caused by our breach, subject always to applicable consumer protection law.

17. Privacy and marketing

We process personal information as described in our separate Farmison & Co Privacy Policy. Electronic marketing is subject to applicable consent and soft opt-in requirements, and customers may opt out in accordance with that policy and the law.

18. Changes, governing law and disputes

The terms applicable to an accepted order are normally those shown when you placed it. We may update these terms for future orders and will publish the revised date. These terms are governed by the laws of England and Wales, without depriving consumers resident elsewhere of mandatory protections afforded by their applicable law. Consumers may bring proceedings in the courts available to them under applicable jurisdiction rules.
